3.1 Leliplanty & Gachet offers a variety of plants and related products for sale. Product descriptions, prices, and availability are listed on the Website and are subject to change without notice.  
 

3.2 We make every effort to ensure that product information is accurate, but errors or omissions may occur. In such cases, we reserve the right to correct any mistakes, cancel orders, or refund payments.  
 

3.3 Product images are for illustrative purposes and may not fully reflect the actual product.  

 

4. User Accounts 
 

4.1 To make purchases or access certain features of the Website, users may need to create an account. When registering, you must provide accurate and complete information.  
 

4.2 You are responsible for keeping your login information secure and confidential. You agree to notify us immediately if you suspect any unauthorized use of your account per mail to leliplanty@gmail.com within 24 hours. 
 

4.3 You are responsible of your behavior and activity on the website. Any malicious activity towards the website, e-mail address of the company or any of the intellectual property of the company is forbidden and may lead to the cancellation of your account as well as legal consequences. 
 

4.4 We reserve the right to suspend or terminate accounts that violate these Terms.  

 

5. Orders and Payments 
 

5.1 By placing an order on the Website, you make an offer to purchase products in accordance with these Terms.  
 

5.2 Prices are listed in Swiss Francs (CHF), and shipping costs may apply. All taxes and additional charges will be displayed before completing your order.  
 

5.3 Payment is due at the time of order. We accept various payment methods, including credit cards, bank transfers, or other methods specified on the Website.  
 

5.4 We reserve the right to cancel an order if payment is not processed or if we suspect fraud.  
 

5.5 By placing an order you place a binding offer and get an automated response as confirmation. This does not yet imply a purchase agreement. The purchase agreement comes about with the shipping of the products. We keep the right to cancel an order. In case of not being able to accept an order, you will be informed via e-mail and all advance payments are reimbursed. 

 

6. Shipping and Delivery 
 

6.1 Shipping times and fees depend on the destination and the size of your order. Estimated delivery times will be provided during checkout.  
 

6.2 Plant orders are always shipped from monday to wednesday with PostPac Priority (A-Post).  
 

6.2 Leliplanty & Gachet is not responsible for delays caused by the carrier or other circumstances beyond our control and leliplanty & Gachet denies any and all liability. 
 

6.3 Leliplanty & Gachet is not liable for incorrect data given by the client. In case of incorrect shipping address, name or any other information that leads to the product not being delivered, the client bears the sole responsibility. 
 

6.4 Risk of damage or loss of products passes to the customer once the product has been shipped.  

 

7. Reservation of Title 
 

7.1 The goods stay in the property of Leliplanty & Gachet until full payment (price of goods and additional fees) has been received and the goods have been shipped. 

 

8. Returns and Cancellations 
 

8.1 For products that are purchased via our website, including perishable and non-perishable products, there is no right of return, exchange or withdrawal. Refunds of the purchase price are not possible. Claims for damages or withdrawal from the contract on the part of the customer are also excluded. Leliplanty & Gachet are not required to give a reason for the acceptance or denial of a return. Returns and exchanges are solely a gesture of goodwill. 
 

8.2 If the wrong product is delivered the client has to object within 3 days of receiving the order. The client will receive a return label to send back the product. Upon sending back the wrongly received product, the replacement will be sent to the client.  
 

8.3 For non-perishable items, you may cancel your order within 14 days of purchase, provided the items have not been opened or used.  An exception applies to gift vouchers; they cannot under any circumstances be canceled or refunded, regardless of the voucher amount.
 

8.4 In case a return or exchange is granted the client has to bear all associated costs including delivery fees.

9. Intellectual Property 
 

9.1 All content on the Website, including text, images, logos, and designs, is the property of Leliplanty & Gachet, or third parties, and is protected by Swiss and international copyright laws.

10. Limitation of Liability 
 

10.1 Leliplanty & Gachet strives to provide accurate information and high-quality products. However, we are not liable for any direct, indirect, incidental, or consequential damages arising from the use of our products or the Website.  
 

10.2 We certify the good health of all our shipped organic products through a phytosanitary passport delivery system based on Switzerland laws (FOAG). However, we are not responsible for the proper care and handling of plants after purchase.  

 

11. Privacy and Data Protection 
 

11.1 We collect and process personal data in accordance with our Privacy Policy, which can be found on the Website leliplanty.com when clicking “privacy” on the foot of the page. By using the Website, you consent to the collection and use of your personal data as outlined in the Privacy Policy.  
 

11.2 We implement appropriate security measures to protect your data, but we cannot guarantee the absolute security of online transactions. 

 

12. Governing Law and Dispute Resolution
